Terms and Conditions

  1. Information on how to enter and all prize details form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. The Promoter is Bupa Australia Pty Limited ABN 81 000 057 590 (Bupa) of 600 Glenferrie Road Hawthorn, Victoria, 3122.
  3. Entry is open to anyone aged 18 and over who participates in this Promotion during the Promotional Period (Eligible Entrants). To be eligible to win the prize Eligible Entrants must be Australian residents at the time of the draw. Entrants do not need to be a Bupa member to enter this Promotion.  Employees (and their immediate families) of the Promoter and agencies associated with this promotion are eligible to enter.
  4. The Promoter reserves the right to verify the validity of entries and Entrants (including an Entrant’s identity, age and place of residence) and to disqualify any Entrant for tampering with the entry process. In addition, such Entrants may be disqualified from this Promotion and may also be disqualified from future promotions run by the Promoter. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of their rights at any stage does not constitute a waiver of those rights. Incomplete, indecipherable, or illegible entries will be deemed invalid.
  5. The Promotion commences at 10am (AEST) on 19 December 2012 and closes at 12noon (AEST) on 31 March 2013 (the Promotion Period).
  6. Each Eligible Entrant who shares this Promotion with at least 3 or more ‘friends’ (at one time) or who posts a link to the Promotion on their social media account, via the Bupa tell-a-friend platform, will receive one entry into the Promotion. That Entrant will receive an additional 10 entries into the Promotion if one of their ‘friends’ subsequently clicks through to the Bupa website from the Eligible Entrant’s referral link and becomes a new Bupa health insurance member by 31 March 2013.
  7.  The following methods can be used to enter this Promotion:
    1. share the Promotion by emailing at least 3 ‘friends’ (in the one entry) via the Bupa tell-a-friend platform which can be accessed through the Bupa Promotion landing page at www.bupa.com.au/tell-a-friend; or
    2. by posting a link to the Promotion on their social media account.
  8. Eligible Entrants will need to sign up to the Bupa tell-a-friend platform which can be accessed through the Bupa Promotion landing page at www.bupa.com.au/tell-a-friend to share the Promotion with ‘friends’ and will need to provide their name and email address. An Eligible Entrant will be contacted by the Promoter at various points via email following signing up for the Promotion:
    1. when the Eligible Entrant first registers and shares with ‘friends’  by email or on a social media site, they will receive an email to confirm they have received one entry into the draw;
    2. whenever a ‘friend’ they have referred becomes a new Bupa health insurance member, the Promoter will notify the Eligible Entrant that they have received more entries into the Promotion (being 10 entries for each new Bupa health insurance member).
  9. Eligible Entrants must have a valid email address to enter the Promotion. Without a valid email address the Promoter will be unable to communicate the referral and reward status to Eligible Entrants. Eligible Entrants are only permitted to email up to 50 ‘friends’ per hour or 300 ‘friends’ per 24 hours. By taking part in the Promotion Eligible Entrants consent to their personal information being handled as outlined in clause 21 of these terms.
  10. If any Eligible Entrant refers a ‘friend’ to the Promotion they must warrant that they have the permission of their ‘friend’ to do so and to use that person’s email address for the purposes of this Promotion. Once an Eligible Entrant has referred a ‘friend’, their ‘friend’ will receive an email from the Eligible Entrant.
  11. Only Eligible Entrants who meet all the requirements set out in these Terms and Conditions are eligible to win. Any cost associated with accessing the online entry form is the Eligible Entrant’s responsibility and is dependent on the Internet service provider used by http://www.bupa.com.au.   
  12. PRIZE DRAW: will take place at Bupa Head Office Australia: 600 Glenferrie Rd Hawthorn, VIC at 11am (AEST) on 4 April 2013. The Promoter’s decision is final and no correspondence will be entered into.
  13. There is one major prize to be won: the first valid entry drawn at random from all valid entries will win the major prize of a Flight Centre Gift Card valued at $5,000 (incl. GST) to be spent on travel and accommodation of their choice and is valued as at 6 December 2012. The winner will be notified via email no later than 5 April 2013. The winner’s details will be published in The Australian on 11 April 2013.
  14. Unless otherwise stated on the Gift Card, Gift Cards are valid for use within 12 months from the date of issue. All components on prize are subject to availability at time of booking. Once booked any changes made to the booking may incur a cancellation fee or amendment fee, at the cost of the winner.  All further costs incurred whereby the prize winner wishes to make variations to the travel are the winner’s responsibility. Gift Cards may be redeemed in whole or part during the validity period. Where used in part, no change will be given. Any unused balance may be used against future purchases, but will not be refunded or credited when the Gift Card expires.
  15. Unless otherwise stated the prize or portions of prizes are not transferable or exchangeable, cannot be sold and no prizes may be taken as cash. The Promoter does not accept responsibility for any variation in the value of the prize. Supplier’s terms and conditions apply. If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prizes with a prize to the equal value and/or specification.
  16.  In the event that for any reason whatsoever the prize winner does not take the prize then that prize will be forfeited by the prize winner and cash will not be awarded in lieu of the prize.
  17. Where the prize remains unclaimed, the Promoter will conduct such further draws as necessary on 4 July 2013 at Bupa Head Office Australia: 600 Glenferrie Rd Hawthorn, VIC  12noon (AEST). The winner of any such unclaimed prize draw will be advised via email no later than 5 July 2013. The winner’s details will be published in The Australian on 11 July 2013.
  18. Except for any liability that cannot be excluded by law, the Promoter (including their officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any recommendation or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Eligible Entrant; or (f) use of the prize.
  19. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
  20. The Promoter does not make any express representations or warranties as to the quality/suitability/merchantability of the prize. The Promoter takes no responsibility in regard to the condition and/or fitness of the prize. The winner should look to the manufacturer or supplier for all warranties and claims.
  21. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers, including Social Twist Inc (US). The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages to the Eligible Entrants. Collection, use and disclosure of information collected in connection with this promotion will be handled in accordance with the Promoter’s Information Handling Policy which can be located at www.bupa.com.au/staticfiles/BupaP3/pdfs/BUPA_Info_Handling_Policy.pdf  Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter. Unless otherwise indicated by you, by participating in this promotion you are agreeing to the Promoter providing you with information in relation to the services and products of the Bupa Australia Group of companies.
  22. The Promoter reserves the right to announce or publish the winner's name and/or photograph for publicity purposes. It is a Term and Condition of entry into this promotion that the winner will consent to the Promoter doing so. Eligible Entrants consent to the Promoter using the winner’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  23. Any cost associated with accessing this Promotion is the Entrant’s responsibility and is dependent on the Internet service provider used.
  24. Entry and continued participation in the Promotion is dependent on Entrants following and acting in accordance with the terms and conditions of the applicable websites.
  25. This Promotion is in no way sponsored, endorsed or administered by, or associated with any social media site. Entrants understand that they are providing their information to the Promoter and not to a social media site. The information an Eligible Entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to a social media site. A social media site will not be liable for any loss or damage or personal injury which is suffered or sustained by an Eligible Entrant, as a result of participating in the promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.
